Energy Labelling Directive 2010/30/EU and Commission Delegated Regulations transposed into Ukrainian national legislation
On August 7, 2013 the Cabinet of Ministers of Ukraine passed Resolution No 702 “On approval of technical regulations on energy labelling”, transposing Directive 2010/30/EU on the indication by labelling and standard product information of the consumption of energy and other resources by energy-related products, and Commission Delegated Regulations 1060/2010 and 1061/2010 with regard to energy labelling of household refrigerating appliances and household washing machines respectively.

The adoption of Resolution No 702 marked a pinnacle of more than a year of successful teamwork between the State Agency on Energy Saving and Energy Efficiency (SAEE) of Ukraine and the European Union Twinning Project “Improvement of the Policy Framework in the Sphere of Energy Efficiency and its Approximation to the requirements of the EU Legislation”.
The activities on Energy Efficiency Standards and Labelling of the Twinning Project were implemented by the director of Energy-Strategies, Wolfgang F. Lutz, in cooperation with Dr Floris Akkerman from the German Federal Institute for Materials Research and Testing (BAM), Department for Ecodesign.
Following the joint elaboration of an appropriate strategy for the transposition of the EU Energy Labelling Directive and Commission Delegated Regulations for individual products, SAEE and the Twinning experts elaborated drafts for the following Technical Regulations:
- Technical Regulation on energy labelling of energy related products
- Technical Regulation on energy labelling of household electric refrigerating appliances
- Technical Regulation on energy labelling of household washing machines
Following in-depth discussions with the relevant authorities and technical bodies in the Working Group on Energy Labelling, the draft Technical Regulations were eventually adopted by the above-mentioned Resolution of the Cabinet of Ministers. The Technical Regulations will apply from April 9, 2014 onwards.
Furthermore, SAEE and the Twinning experts established a list of further products to be regulated with priority, taking into consideration the obligations stemming from the Energy Community Treaty and the assumed energy saving potentials of these products. In addition to household refrigerating appliances and household washing machines, draft Technical Regulations have been elaborated for the following products:
- Air conditioners
- Televisions
- Lamps and luminaires
The technical regulations for these products were discussed in the Working Group on Energy Labelling and have already entered the administrative procedures for approval by the authorities concerned.
As a final step, the Twinning experts provided assistance to SAEE in preparatory activities with regard to the following additional products:
- Household tumble driers
- Household dishwashers
- Water heaters, hot water storage tanks and packages of water heater and solar device
- Space heaters, combination heaters, packages of space heater, temperature control and solar device and packages of combination heater, temperature control and solar device
Parallel to these activities, corresponding European harmonised measurement standards were identified. While some of the standards are still in the process of elaboration by CEN/CENELEC or awaiting approval and publication, several standards are already available and ready for adoption as Ukrainian National Standards.
In addition to the meetings of the Working Group on Energy Labelling, SAEE organised two seminars for stakeholders, including representatives of suppliers and distributors of energy-using products. Last, but not least, a study visit to Germany provided SAEE staff with first-hand insights into current activities and developments in energy efficiency standards and labelling in a EU member state.
Due to the collaborative effort led by SAEE, first, yet decisive steps have been taken towards the implementation of a state-of-the-art energy labelling scheme in Ukraine, which is fully harmonised with current EU legislation in this field.

In addition to his role as key expert for energy efficiency standards and labelling, Wolfgang F. Lutz was also in charge of the gap analysis in the framework of Subcomponent 1.3: Energy Audits and Energy Management.
The activities were carried out on behalf of the ‘Mandated Institution’ B.&.S.U. Beratungs- und Service Gesellschaft Umwelt, Berlin, Germany, in the framework of the EU Twinning Project “Improvement of the Policy Framework in the Sphere of Energy Efficiency and its Approximation to the requirements of the EU Legislation”, which was jointly implemented by SAEE and a German-French Consortium led by the German Federal Ministry of Economy and Technology.
